Function, proficiency, and actual-risk context

An unfamiliar device can prompt a legitimate safety question. Device appearance alone does not answer what disability-related function it serves, how it is operated, or what risk exists in a particular setting.

Actual federal accommodation in 2007; classification left unresolved

In 2007, FTA assumed the disputed mobility-aid proposition in Troy’s favor for its civil-rights analysis. It found that BART had not demonstrated direct threat in concourses and BART-controlled outside areas and required accommodation there subject to fact-based restrictions. It accepted restrictions on platforms and heavy-rail vehicles based on the risks analyzed. FTA therefore ordered real accommodation in specified environments while leaving the underlying classification question unresolved.

Nineteen years of subsequent accommodation, operational experience, individualized government review, and governed N-of-1 evidence have not produced a durable federal classification in the reviewed history. Recognition does not travel: a new institution can restart the question of disability-related function. Portable recognition with bounded reassessment is the proposed response, carrying verified function and scoped conditions forward while preserving individualized actual-risk review in the receiving environment.

Official FTA determination

“FTA will address the direct threat and reasonable modification issues as if the other issues were decided in your favor”

FTA Complaint 06-0135, October 15, 2007, original page 2

The remaining sentence permits BART to raise the reserved issues separately. FTA’s class-level analysis on page 3 was not a universal classification: it required accommodation in concourses and BART-controlled outside areas subject to fact-based restrictions, while accepting platform and heavy-rail restrictions. Historical access accounts and their evidentiary status remain distinct from measured experimental observations. Aviation and retailer accounts do not enter scientific datasets or denominators. Current review drafts are not court findings or publication-approved document downloads.

Federal accommodation, practical implementation—and the next institutional boundary

2007 — FTA: “Accordingly, FTA will address the direct threat and reasonable modification issues as if the other issues were decided in your favor, but allow BART to raise them separately if it chooses.” FTA expressly directed BART to permit skate use in concourses and BART-controlled outside areas subject to fact-based restrictions. That affirmative accommodation directive was consequential even though FTA accepted platform and heavy-rail restrictions and reserved disability, mobility-aid classification and fundamental-alteration questions. Read the complete finding, pages 2 and 8.

2008 — BART/SamTrans: BART’s February 8, 2008 implementation letter supported regular ADA ParaTransit eligibility through SamTrans and undertook to ask partner operators to permit riding while wearing the skates. It described temporary eligibility for 30 days from the letter while Troy applied and attended the required interview. Troy separately reports passing RediWheels’ functional assessment and nearly two decades of subsequent use.

2022 — California DMV: After individualized review, the driving record states: “Driver operates a motorcycle and class C vehicle using inline skates.” The June 17 order ended the suspension and lists June 16 reinstatement. Its operational scope is distinct from general ADA classification.

FTA ordered an actual accommodation in 2007; it did not finally resolve mobility-aid classification. Nineteen years later, BART’s implementation, California DMV’s individualized review and documented accommodation history have not produced consistent recognition across institutional boundaries. How should verified disability-related function and prior scoped decisions inform the next review? Portable recognition with bounded reassessment is the proposed response, preserving individualized actual-risk review and legitimate local safety requirements. Recognition should travel. Risk assessment remains local.

Historical context and measurement boundaries · Proposed technology-neutral standard

What the record does and does not establish

The FTA required a clear, fact-based direct-threat decision in the particular circumstances, rather than a speculative, conclusory, discriminatory, or unlikely scenario. Its 2007 decision evaluated a competent class-level user despite acknowledging Petitioner's documentation of particularly safe operation. Petitioner says he submitted Techniques and videos; the recovered record does not establish how each was reviewed.

Federal-building access and recipient-specific requests

Troy reports that federal-building entry procedures made filing painful after removal of his prosthetic skates and moved a scheduled pro bono consultation outside, limiting privacy, Internet access, and physical-record review. This account is historical and administrative context, not an experimental measurement or an adjudicated access finding. He requests DOJ/GSA review of federal-building procedures and DOJ/DOT/FTA review of transportation accommodation; the request does not establish a duty to reopen a particular complaint.

Federal record, Executive and Legislative requests, and certiorari status · Source-labeled access chronology · Proposed technology-neutral standard. Revised briefs and petition remain review candidates; no new private document is published here.

Service timing and measured exposure answer different questions

Pickup lateness is waiting beyond an agreed service time; ride duration is time aboard. Neither should be substituted for the other or inferred from a heart-rate or acceleration trace. Historical service complaints belong in the administrative context layer, not experimental denominators. Current transportation review and source-linked service criteria are separate from the approved measurements.

A proxy is not the outcome

Appearance is not disability function; a predicted fall is not an observed incident; body-worn acceleration is not internal pelvic force; and a brief heart-rate peak is not sustained burden. Historical decisions and operating reports are not added to scientific denominators.

The next individualized review can carry forward verified function, demonstrated proficiency, prior scoped decisions, operating history, and conditions, while reassessing a materially different environment or credible new risk. Prior recognition is evidence, not universal permission.

Complementary institutional roles

Courts resolve concrete disputes; executive agencies administer and coordinate civil-rights standards; and legislatures can create durable, technology-neutral structures where familiar device categories leave gaps. This is a proposed policy framework, not a request for the branches to coordinate the disposition of a particular case.

Current reviewed experimental evidence cutoff: October 10, 2026 service day. Later observations require separate review. This historical context is not a new scientific result.

Historical / administrative context: the reported frontline consequence

Troy reports multiple encounters with the San Mateo Police Department involving the same prosthetic skates: San Mateo County Fair/Event Center access disputes; motorcycle operation while wearing inline skates; an earlier Hillsdale/security incident he says was resolved without terminating the accommodation; and the October 2026 Swarovski dispute. On his account, San Mateo Police repeatedly become the frontline enforcement interface when another institution disputes his non-standard mobility aid. Event details remain Troy-reported where primary police reports, notice, or body-camera records are unavailable; this is not a finding of police misconduct or adjudicated discrimination.

A responding officer should not have to reconstruct decades of accommodation and individualized government review during a sidewalk, retail, event, or security encounter. Prior recognition does not eliminate immediate safety authority. A minimum-information record should surface verified disability-related function, prior scoped determinations, proficiency, and operating conditions while allowing bounded reassessment of actual behavior and current risk.

Recognition should travel. Risk assessment remains local. Demonstrated proficiency is evidence, not universal permission.
